1. Dr Von Schrenk’s registration is suspended for a period of three calendar months commencing 1 November 2008.
2. Dr Von Schrenk is reprimanded.
3. Dr Von Schrenk is fined $4000, such sum to be paid into the Dental Practice Fund by no later than 4pm Friday 5 December 2008.

Following assessment by a dentist appointed by VCAT as a special referee, Dr Olstein was assessed as being clinically competent in the Areas in which the Panel had ordered that he undergo further education. Accordingly, VCAT ordered, by consent, that paragraphs 1 - 6 of the Panel’s Determination made 15 August 2007 (which dealt with the suspension and further education) be set aside and that paragraph 7 (which dealt with the reprimand) be affirmed. |

Drs AA and BB applied to VCAT for a review of the Board’s determination in this matter. On 15 June 2007, Senior Member Davis of VCAT replaced the Board’s finding and determinations with the following:
i) The applicants have pursuant to s 47(2)(b) of the Dental Practice Act 1999 engaged in unprofessional conduct not of a serious nature;
ii) Drs AA and BB are reprimanded for their conduct; and
iii) Drs AA and BB are cautioned against a repetition of that conduct.

The Board appealed against VCAT’s finding that the unprofessional conduct was not of a serious nature. The appeal was allowed.
The Honourable Justice Hargrave set aside VCAT's order and sent the matter back to VCAT for rehearing.
Costs of the appeal were awarded to the Board.

The matter was reheard in VCAT on 30 April 2007 before Deputy President Macnamara. On 9 May 2007 he handed down his decision affirming the Board’s finding that Dr Hassed had engaged in unprofessional conduct of a serious nature. The Board’s determinations were varied such that Dr Hassed was fined the sum of $4,000 to be paid within 30 days of 9 May 2007. Further Dr Hassed was cautioned to ensure that in future his advertisements were not false, misleading or deceptive.

Dr Exler applied to VCAT for a review of this decision. VCAT confirmed that Dr Exler was guilty of three counts of unprofessional conduct of a serious nature. The tribunal also confirmed that Dr Exler’s registration would be suspended for 180 days. That period of suspension to commence on 3 January 2006. The tribunal reduced the total amount of fines payable by Dr Exler from $30,000 to $17,500.
